Licensing terms of HyperFluxCMS

Before installing and using HyperFluxCMS, you must carefully read these terms of use that govern the system's usage license.

By installing, using, or redistributing HyperFluxCMS, you automatically affirm that you have read, understood, and fully agree with all the terms of use described in this document. If you disagree with any point or have any questions, do not install, use, or redistribute HyperFluxCMS.

1. Introduction

This is an agreement between SCI Brasil Tecnologia Ltda (hereinafter referred to simply as "SCI"), a legal entity duly constituted in the Federative Republic of Brazil, and You. If you are installing HyperFluxCMS (which may also be referred to as "System" or "Software" or "Project" throughout this document) on behalf of or under the orders of a company or another individual, they will also be automatically subject to these terms of use, and you both will be co-responsible for the fair use of the system. You and the company or third party will be referred to as "You", "You all", "User", or "Users".

2. License Grant

SCI grants the user a free license to use the HyperFluxCMS system so that you can use it for the purposes for which the system is intended. This usage license allows the installation and use of the system on an unlimited number of computers, including virtual machines, for an unlimited period as long as the terms of this document are being complied with.

Granting the license gives the right to install and use the system, but under no circumstances does it mean the transfer of intellectual property rights, which will continue to belong to SCI.

3. Redistribution

The user may distribute copies of the system provided they comply with the following requirements.

  • The user cannot claim to be the creator, co-creator, or have any property rights over the system, which belong to SCI.
  • The system must be distributed free of charge, without any type of fee, whether one-time or recurring. However, You may offer additional services to your clients (such as hosting, web design, management, etc.) and charge for them, making it clear that the charge refers to such services, not to HyperFluxCMS.
  • When distributing the software, it is preferable to do so via a link to the Project's official website, to ensure that the distributed version is the most recent, as well as this Terms of Use document. Distribution on physical media, "pen drives", CDs, DVDs, or making the file available on websites other than the official site is not expressly prohibited, but it is highly discouraged.
  • When distributing the software in compressed/aggregated format (such as zip, rar, tar.gz, etc.), it is not allowed to include other applications, documents, and files that are not part of the original distribution in the same file. However, it is permitted that, on the same media or site, other applications, files, documents, and files be distributed side by side as long as they are clearly identified as separate files that are not part of HyperFluxCMS.

4. Derivative works

A software developer or distributor may create derivative works of HyperFluxCMS provided they comply with the following requirements:

  • This document must be distributed unchanged (including the file name) along with the derivative work files.
  • SCI must be credited as the author of the original project.
  • The original work must be free of charge, at least for the functionalities that were already available in the original work. However, the developer may create versions of the system with additional functionalities and charge for them.
  • The derivative work must also contain this Terms of Use document, unaltered, and credit SCI for the original work.
  • The derivative work must not contain illegal or malicious algorithms, applications, or files, such as viruses, spyware, malware, etc.
  • Developers may also use small snippets of code, such as algorithms, functions, and classes, to use in any other software projects that are not related to HyperFluxCMS and have completely different objectives, as long as they are free (Freeware, open-source, or similar) and SCI and the HyperFluxCMS project are credited. For commercial software for profit, the same right is granted, provided that credits are included for SCI and the HyperFluxCMS project and the limit of 1500 (one thousand five hundred) lines of code (counting includes blank lines and comments counted from the original source code files) taken from the HyperFluxCMS project source code is respected. To use a greater amount of original code from the HyperFluxCMS project in a commercial software project, SCI must be contacted to negotiate a commercial agreement.

5. SCI's Commitments

SCI guarantees that the system, in its original form made available for download on the site, is free of intentional malicious software such as viruses and spyware.

SCI reserves the right to create versions of HyperFluxCMS with additional functionalities that are not free, and may be charged, at SCI's discretion, a fixed and/or recurring amount. However, SCI commits to always offering a free version of HyperFluxCMS, which contains, at a minimum, the same functionalities as the previous free version. That is, when updating a free version of HyperFluxCMS to a more recent free version, the user will not lose access to the functionalities they used.

SCI will make efforts, within its possibilities and availability of human resources, to keep the system constantly improving in order to include new functionalities and correct any bugs and problems.

6. Disclaimers

The User understands that the system may contain bugs, flaws, and vulnerabilities and, by using it, assumes all potential risks. SCI will make efforts to correct them as soon as possible according to its capabilities. But this does not mean an obligation, and under no circumstances can SCI be held responsible for any types of damages and losses, material or moral, caused by the use or inability to use the system.

Under no circumstances can SCI be held responsible for misuse of the software, for example, using it to distribute illegal material. The responsibility lies entirely with the user and the people to whom they have delegated permissions to use the system.

7. Users' Obligations

By installing and using the system, the user commits to following, among other terms of this document, the following terms:

  • Keep security systems always updated (operating system, firewall, antivirus, etc.).
  • Ensure that the people authorized to use the system are trustworthy and do not use it for malicious or illegal purposes.
  • Do not use and do not allow your users to use the system for illegal purposes, such as making available pirated material, photos and videos prohibited by law, viruses and malware, imitating famous websites to deceive visitors, creating websites for the purpose of spreading "fake news", slander, racist, xenophobic, homophobic speeches, or that promote or advocate hatred, intolerance, discrimination, and violence in general, among other crimes provided for in Brazilian law or in the country where the hosting server you hire is located.
  • Regularly visit the official HyperFluxCMS Project website to check for possible releases of new versions that may correct critical problems, as well as changes to this Terms of Use document and other important notices.

8. License Revocation

If any part of this terms of use agreement is breached by the user, the HyperFluxCMS usage license will be automatically revoked, and it will then be considered Commercial Software for the infringing user, at the unit cost of 300 UPF-PR (Fiscal Standard Unit of the State of Paraná) or equivalent value, per installed machine (also counting the number of virtual machines), which license may be judicially charged, including multiplied by the maximum value allowed by law for crimes of illegal software use (piracy).

9. Update of Terms of Use

The HyperFluxCMS Terms of Use may be updated at any time without prior notice. Any changes will be published on the Project's official website. It is the user's obligation to regularly visit the Project's official website to check for changes to the terms, as well as other important notices.

10. General Terms

Any disputes must be handled according to the laws of the Federative Republic of Brazil.

As this is a service freely provided by SCI, without any obligation of payment (except in the case of item 8) or consideration, and without SCI even knowing who is using the system, the relationship between SCI and the user does not constitute a Consumer Relationship, and therefore the Consumer Protection Code or any similar law does not apply.

In the event that one or more clauses, phrases, expressions, or words contained in this document are considered null and void, only the null parts shall be disregarded, and the entire remaining content of the document shall remain valid.

To settle any legal issues, SCI and the users elect the District of Curitiba - PR, for mediation and judgment, waiving any others, no matter how privileged.
